1. This product was made using the Polymerase Chain Reaction (“PCR”) process which is covered by patents owned by Roche Molecular Systems, Inc. and F. Hoffman-La Roche Ltd (“Roche”). No license to use the PCR process is conveyed expressly or by implication to the purchaser by the purchase of this product. 10. Use of the CMV promoter is covered under U.S. Patent Nos. 5,168,062 and 5,385,839 owned by the University of Iowa Research Foundation and licensed FOR RESEARCH USE ONLY.

Purchase of these products is accompanied by a license to use them in the Polymerase Chain Reaction (PCR) process in conjunction with a thermal cycler whose use in the automated performance of the PCR process is covered by the up-front license fee, either by payment to Applied Biosystems or as purchased, i.e., an authorized thermal cycler.

Certain hrGFP products, and other products containing hrGFP variants, are covered by the following license terms: Use of Stratagene’s Vitality™ hrGFP products containing DNA sequences coding for Renillareniformis green fluorescent protein (GFP) variants or proteins thereof (“Products”) requires a license from Stratagene. With purchase of the Products, non-profit research entities are granted a complimentary license for non-commercial research use, the terms of which are disclosed in detail in the Non-Commercial Research Use License for Nonprofit Entities accompanying the Products. Commercial entities are granted a license for non-commercial research use, the terms of which are disclosed in detail in the Non-Commercial Research Use License for Commercial Entities. These licenses specifically exclude any rights to (i) modify the coding region of the nucleic acid encoding the fluorescent protein of the Products, (ii) offer the Products, or any components, derivatives or modifications thereof, for resale, or (iii) distribute, transfer, or otherwise provide access to, the Products, or any components, derivatives or modifications thereof, to any third party for any purpose or use. 14. Practice of the patented polymerase chain reaction (PCR) process requires a license. The Mx3000P™ real-time PCR system is an Authorized Thermal Cycler and may be used with PCR licenses available from Applied Biosystems. Its use with Authorized Reagents also provides a limited PCR license in accordance with the label rights accompanying such reagents.
